01Introduction

Titan Total Training LLC (the “Company” or “We”), DBA T3 Fitness, respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit the website www.t3fitnesstx.com (our “Website”) or use sign-in tablets or kiosks at our physical locations, and our practices for collecting, using, maintaining, protecting, and disclosing that information. This policy applies to information we collect:

  • On this Website.
  • In email, text, and other electronic messages between you and this Website.
  • Through any devices or systems provided by us, including sign-in tablets or kiosks at our physical locations.

It does not apply to information collected by us through offline means other than the sign-in tablets or kiosks mentioned above, or through any other means not described in this policy, including on any other website operated by the Company or any third party; or by any third party (including our affiliates and subsidiaries), including through any application or content that may link to or be accessible from or through the Website.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Website. This policy explains our practices; it does not replace any consent required by applicable law. We may change this policy on one or more occasions (see Changes to Our Privacy Policy). Updates do not authorize new uses of information collected under an earlier promise. We obtain additional consent where required.

02Children Under the Age of 16

Our Website is not intended for children under 16 years of age. No one under age 16 may provide any information to or on the Website. We do not knowingly collect personal information from children under 16. If you are under 16, do not register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any username you may use.

If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us at contact@titantotaltraining.com. We do not knowingly collect personal information from children under 16 through our sign-in tablets or kiosks. If you are under 16, please refrain from using these devices.

Residents of certain states under 13, 16, or 18 years of age may have additional rights regarding the collection and sale of their personal information. Please see Your State Privacy Rights for more information.

03Information We Collect About You

We collect several types of information from and about users of our Website, including information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, or date of birth; health-related information (weight, height, dietary preferences); and payment details for subscription-based services (“personal information”);
  • That is about you but individually does not identify you, such as demographic, statistical, or aggregated information; and
  • About your internet connection, the equipment you use to access our Website, and usage details.

We collect this information directly from you when you provide it to us; automatically as you navigate through the site (which may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies); and from third parties, for example, our business partners.

Information You Provide to Us

The information we collect on or through our Website may include information you provide by filling in forms (including when registering, subscribing to our service, or requesting further services, entering a contest or promotion, or reporting a problem); records and copies of your correspondence if you contact us; your responses to surveys; details of transactions you carry out and the fulfillment of your orders (you may be required to provide financial information before placing an order); and your search queries on the Website.

Website inquiries and membership checkout

Inquiry forms collect the contact information and message you choose to submit so T3 can respond. Personal training requests go to Marci and the T3 team. FullExperience operates our website and inquiry systems, and service providers help store requests and deliver notification emails. Please do not put payment card numbers, passwords, medical records, or other sensitive details in an inquiry message.

Online enrollment uses Club Automation / Daxko and its payment services, including Shift4 / i4Go. Payment entry is provided by the payment service. The enrollment system receives a payment token, masked payment information and transaction results to complete the membership request. Review the payment provider’s notices and your membership agreement at checkout. Website privacy preferences do not disable the essential tools needed for enrollment and fraud prevention.

Cookies, analytics and privacy choices

Optional analytics and advertising measurement are off until you choose “Allow optional.” Google Tag Manager / Google Analytics, Meta Pixel and our conversion measurement relay may then process page visits, device and browser information, cookie identifiers and interactions such as inquiry submissions. Our website’s general form tracking does not collect the contents of form fields for advertising. Google and Meta may process measurement data under their own privacy policies.

Change your privacy choices at any time, or use the “Privacy choices” link in the footer. “Essential only” disables optional tracking on this website; withdrawing permission reloads the page to stop previously loaded optional scripts. We honor Global Privacy Control by keeping optional tracking off, even if you previously opted in. Your choice is saved in this browser for up to one year when browser storage is available. Clearing storage or using another browser may require a new choice.

Essential hosting, security and error monitoring help operate and protect the website. Our hosting, email delivery, embedded map, image delivery, enrollment and error-monitoring providers may receive information needed to deliver their services. The website’s checkout document does not load our marketing tag manager, advertising pixel or optional analytics scripts. Independently operated pages and services have their own policies and controls.

Automatic Data Collection Technologies

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including details of your visits (traffic data, location data, logs, and other communication data) and information about your computer and internet connection (IP address, operating system, and browser type). This helps us improve our Website and deliver a better, more personalized service — estimating audience size and usage patterns, storing information about your preferences, speeding up searches, and recognizing you when you return.

The technologies we use may include cookies (small files placed on your device; you may refuse them via your browser settings, though some parts of the site may become inaccessible) and web beacons (small electronic files that permit the Company to count users who visited pages or opened an email and for other related statistics).   • To allow you to participate in interactive features, provide customer care and support, monitor use of our Website, and detect, prevent, and address technical issues.
  • To manage gym attendance and services, such as scheduling fitness sessions or tracking usage of gym facilities.

We may also use your information to contact you about our own and third parties’ goods and services that may be of interest to you. 05Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates, and to contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. For example, we use Google Analytics to help us understand how our users use our Website (see policies.google.com/privacy).
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Titan Total Training LLC’s assets.
  • To fulfill the purpose for which you provide it, for any other purpose disclosed by us when you provide the information, and with your consent.

We may also disclose your personal information to comply with any court order, law, or legal process, including to respond to any government or regulatory request; to enforce or apply our Terms of Use and other agreements, including for billing and collection; and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Titan Total Training LLC, our customers, or others, including for fraud protection and credit risk reduction.

06Your Choices

We strive to provide you with choices regarding the personal information you provide to us:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of this site may then be inaccessible or not function properly. You can opt out of Google Analytics at tools.google.com/dlpage/gaoptout.
  • Promotional Offers. If you do not wish to have your contact information used by the Company to promote our own or third parties’ products or services, you can use the unsubscribe instructions provided in promotional messages or email your request to contact@titantotaltraining.com. If we have sent you a promotional email, you may reply asking to be omitted from future distributions. Opting out of marketing does not prevent necessary service messages about an existing inquiry, membership, transaction or security issue. Providing a phone number in an inquiry is not consent to automated promotional texts. Any marketing text program must provide its own enrollment and opt-out disclosures.

07Accessing and Correcting Your Information

Email contact@titantotaltraining.com to request access to, correction of, or deletion of your information. We may need information to verify your request. Some records may need to be retained for membership administration, legal obligations, security, or resolving disputes. Do not email passwords or full payment card details. For information held in a separate membership service, contact T3 for help locating the correct account controls.

08Your State Privacy Rights

State consumer privacy laws may provide residents with additional rights regarding our use of their personal information. California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information’s nature and the processing purpose (excluding Iowa and Utah).
  • Data portability.
  • Opt out of personal data processing for targeted advertising (excluding Iowa), sales, or profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
  • Either limit (opt out of) or require consent to process sensitive personal data.

The exact scope of these rights may vary by state. To exercise any of these rights, email us at contact@titantotaltraining.com. To appeal a decision regarding a consumer rights request, provide a detailed explanation of why you believe the decision was incorrect, along with any supporting information, via email to contact@titantotaltraining.com. We handle requests and appeals within the deadlines that apply under applicable law and explain any applicable exceptions or further options.

Nevada provides its residents a limited right to opt out of certain personal information sales. Residents who wish to exercise this right may submit a request to contact@titantotaltraining.com. However, we do not currently sell data triggering that statute’s opt-out requirements.

09Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The website uses HTTPS, restricted server-side access and safeguards designed to reduce unauthorized access and abuse. No system can guarantee absolute security.

The safety and security of your information also depends on you. Where we have given you (or you have chosen) a password for access to certain parts of our Website, you are responsible for keeping it confidential. We ask you not to share your password with anyone, and to be careful about giving out information in public areas of the Website. Unfortunately, the transmission of information via the internet is not completely secure; although we do our best to protect your personal information, we cannot guarantee its security, and any transmission is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

10Data Protection

T3 Fitness values your privacy and is committed to protecting your personal information. Information is used to operate T3’s services, respond to requests, protect the website, and perform the optional measurement described above when enabled. Advertising measurement can involve disclosures to advertising platforms. Depending on the applicable law, these disclosures may be considered sharing or targeted advertising. Choose “Essential only” to keep those optional tools off on this website. This update does not authorize a new use of information collected under earlier privacy promises.

Retention

Retention depends on the record and the purpose for which it was collected, including responding to inquiries, administering memberships, accounting, security and legal obligations. Some providers maintain their own records under their policies. Contact T3 to request deletion or ask about a particular record. We do not promise a single deletion period for every system.

11Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated. If we make material changes to how we treat our users’ personal information, we will notify you by email to the primary email address specified in your account or through a notice on the Website home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for you, and for periodically reviewing this policy for changes.
